{"id":73087,"date":"2026-02-24T14:22:26","date_gmt":"2026-02-24T19:22:26","guid":{"rendered":"https:\/\/bridgemi.com\/?p=73087"},"modified":"2026-02-25T13:24:10","modified_gmt":"2026-02-25T18:24:10","slug":"michigan-enbridge-battle-over-line-5-pipeline-before-us-supreme-court","status":"publish","type":"post","link":"https:\/\/bridgemi.com\/michigan-environment-watch\/michigan-enbridge-battle-over-line-5-pipeline-before-us-supreme-court\/","title":{"rendered":"Michigan, Enbridge battle over Line 5 pipeline before US Supreme Court"},"content":{"rendered":"\n<ul class=\"wp-block-list\">\n<li><strong>The US Supreme Court heard arguments Tuesday in a yearslong legal dispute over the fate of the Line 5 pipeline<\/strong><\/li>\n\n\n\n<li><strong>Michigan Attorney General Dana Nessel has been pushing for years to shut the pipeline down, while Enbridge Energy contends she has no legal right to do so<\/strong><\/li>\n\n\n\n<li><strong>The dispute\u2019s outcome may rest on the Supreme Court\u2019s interpretation of a narrow question about court deadlines<\/strong><\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity is-style-wide\"\/>\n\n\n\n<p>It may seem like a dull procedural question: Which court \u2014 federal or state \u2014 should oversee a lawsuit over the fate of the Line 5 pipeline?<\/p>\n\n\n\n<p>But the answer could make or break Michigan Attorney General Dana Nessel\u2019s yearslong effort to shut down the controversial petroleum pipeline. It would also set a precedent for how closely courts must follow legal deadlines meant to avoid drawn-out cases and how much power states have to regulate the fossil fuel industry.<\/p>\n\n\n\n<p>So the stakes were high on Tuesday as lawyers for Nessel and pipeline owner Enbridge Energy <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2025\/24-783_k537.pdf\">pleaded their case<\/a> before the nation\u2019s highest court.<\/p>\n\n\n\n<p>The arguments stemmed from a lawsuit Nessel filed in the 30th Circuit Court in Ingham County in 2019, seeking to shut down a 4-mile stretch of the Canadian oil pipeline that runs through the Straits of Mackinac over fears it could cause a catastrophic oil spill in the Great Lakes.<\/p>\n\n\n\n<p>Nearly two years later, Enbridge filed to move the case to federal court \u2014 long after the 30-day statutory deadline to do so.&nbsp;<\/p>\n\n\n\n<p>That prompted a dispute over whether courts can grant exceptions to the deadline. The Supreme Court <a href=\"https:\/\/bridgemi.com\/michigan-environment-watch\/us-supreme-court-hear-line-5-pipeline-dispute-between-michigan-enbridge\/\">got involved<\/a> after Enbridge appealed a lower court ruling that upheld the deadline.<\/p>\n\n\n\n<p><strong>RELATED:<\/strong>&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/bridgemi.com\/michigan-environment-watch\/feds-take-another-step-toward-decision-on-line-5-tunnel\/\"><strong>Feds take another step toward decision on Line 5 tunnel<\/strong><\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/bridgemi.com\/michigan-environment-watch\/michigan-supreme-court-to-consider-line-5-permit-challenges\/\"><strong>Michigan Supreme Court to consider Line 5 permit challenges<\/strong><\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/bridgemi.com\/michigan-environment-watch\/line-5-tunnel-option-rushed-and-unsafe-opponents-say\/\"><strong>Line 5 tunnel option \u2018rushed\u2019 and unsafe, opponents say<\/strong><\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/bridgemi.com\/michigan-environment-watch\/federal-judge-michigan-has-no-authority-to-shut-down-line-5\/\"><strong>Federal judge: Michigan has no authority to shut down Line 5<\/strong><\/a><\/li>\n<\/ul>\n\n\n\n<p>So why are the two sides so concerned about where the case lands?&nbsp;<\/p>\n\n\n\n<p>In part because federal courts are <a href=\"https:\/\/bridgemi.com\/michigan-environment-watch\/ignore-buzz-heres-why-enbridge-line-5-wont-likely-close-anytime-soon\/\">considered more likely<\/a> to sympathize with Enbridge\u2019s argument that the pipeline should stay open, while state courts are more likely to sympathize with Nessel\u2019s argument that the pipeline should shut down.<\/p>\n\n\n\n<p>Indeed, a federal judge has <a href=\"https:\/\/bridgemi.com\/michigan-environment-watch\/federal-judge-michigan-has-no-authority-to-shut-down-line-5\/\">already decided a separate shutdown dispute in Enbridge\u2019s favor<\/a>, ruling that federal pipeline safety laws preempt state laws, leaving Michigan with no \u201cpower to interfere\u201d in Line 5 operations.<\/p>\n\n\n\n<p>On Tuesday, Enbridge lawyers argued the 30-day removal deadline is malleable, while state lawyers argued it\u2019s firm.<\/p>\n\n\n\n<p>Pointing to other cases in which courts have used a legal principle known as \u201cequitable tolling\u201d to grant deadline extensions, Enbridge lawyer John Bursch urged the court to do the same in this case.<\/p>\n\n\n\n<p>\u201cThere\u2019s no need to break new ground here,\u201d Bursch said. \u201cWe ask that you apply the court&#8217;s well-settled precedents.\u201d<\/p>\n\n\n\n<p>But state Solicitor General Ann Sherman contended that such extensions apply specifically to deadlines for filing cases \u2014 not efforts to swap courts years into an active case.<\/p>\n\n\n\n<p>\u201cHaving missed Congress&#8217;s express mandatory 30-day removal deadline by over two years, Enbridge seeks an atextual escape hatch,\u201d Sherman said.<\/p>\n\n\n\n<p>The legal disputes follow years of tensions over the fate of Line 5, as the structure\u2019s fans and foes battle over how best to reduce the risk of an oil spill from the 72-year-old pipeline that has been repeatedly struck by ships\u2019 anchors as it crosses the open water of the Straits.<\/p>\n\n\n\n<p>Environmentalists and Native American tribes contend the pipeline should be shut down immediately and permanently, while Enbridge and its allies in business and labor want to keep the current lakebottom segment running until it can eventually be moved into a concrete-lined tunnel deep beneath the lakebed.<\/p>\n\n\n\n<p>Asked why Enbridge didn\u2019t seek to move Nessel\u2019s lawsuit to federal court earlier, Bursch contended that the federal implications of the case only became clear after a series of safety mishaps prompted Gov. Gretchen Whitmer to revoke a 1953 easement granting Enbridge access to the Straits in 2020.<\/p>\n\n\n\n<p><em>Check out this audio story from <a href=\"https:\/\/www.interlochenpublicradio.org\/upnorthlowdown\">Interlochen Public Radio<\/a> on the Supreme Court hearing on Line 5:<\/em><\/p>\n\n\n\n<figure class=\"wp-block-audio\"><audio controls src=\"https:\/\/bridgemi.com\/wp-content\/uploads\/2026\/02\/IPR-Line-5-at-SCOTUS.mp3\"><\/audio><\/figure>\n\n\n\n<p>Whitmer&#8217;s revocation prompted a flurry of legal wrangling, including Canada\u2019s invocation of a 1977 <a href=\"https:\/\/www.treaty-accord.gc.ca\/text-texte.aspx?id=101884\">treaty<\/a> that states \u201cno public authority\u201d in the US or Canada can impede the flow of petroleum products through cross-border pipelines.<\/p>\n\n\n\n<p>Those developments \u201creally changed the landscape,\u201d Bursch said.&nbsp;<br>Enbridge successfully sued over Whitmer\u2019s shutdown order in federal court, with US District Court Judge Robert Jonker ruling in December that federal pipeline safety law left Michigan no authority to order a shutdown. The state is appealing that decision.<\/p>\n\n\n\n<p>Justices appeared to wrestle Tuesday with the complexity of Michigan\u2019s dispute with Enbridge, with Justice Sonia Sotomayor wondering aloud about the implications of letting one case proceed in state court while another is active in federal court.<\/p>\n\n\n\n<p>\u201cWouldn\u2019t it avoid waste to have these two actions proceed together in the same court?\u201d Sotomayor asked.<\/p>\n\n\n\n<p>It\u2019s not clear when the court will issue a ruling in the case.&nbsp;<\/p>\n\n\n\n<p>While Enbridge and Michigan battle over the fate of the current pipeline, the company is still seeking permits to build the tunnel it first proposed in 2018.<\/p>\n\n\n\n<p>The US Army Corps of Engineers is expected to make a long-awaited tunnel permitting decision within weeks. Alongside that process, the Michigan Department of Environment, Great Lakes and Energy is weighing whether to grant tunnel permits, with a decision expected in March.<\/p>\n\n\n\n<p>Meanwhile, the Michigan Supreme Court is set to hear arguments on March 11 in <a href=\"https:\/\/bridgemi.com\/michigan-environment-watch\/michigan-supreme-court-to-consider-line-5-permit-challenges\/\">a lawsuit challenging a separate tunnel permit<\/a> the state already granted.&nbsp;<\/p>\n\n\n\n<p>In that December 2023 decision, the Michigan Public Service Commission gave Enbridge permission to reroute Line 5 into the tunnel, if and when it is built.
