Whether the county can use local public health rules to stop the development of solar farms and battery storage facilities.<\/p>\n\n\n\n<p>The St. Clair County Board of Commissioners voted Thursday to appeal a judge\u2019s ruling that struck down public health regulations the county adopted to limit large-scale renewable power projects.<\/p>\n\n\n\n<p>\u201cI think we owe it to the community to follow through with what we started,\u201d said board chair Steven Simasko ahead of the unanimous vote, adding that further action could result in \u201can appeal to the Supreme Court as well.\u201d<\/p>\n\n\n\n<p>Officials with the St. Clair County Health Department advised the board that data centers and energy facilities \u201cconstitute a potential public health risk,\u201d and drafted a series of regulations to curb their development to protect the community against \u201cvisual pollution,\u201d \u201charmful\u201d noise and unspecified \u201ccontamination.\u201d&nbsp;<\/p>\n\n\n\n<p><strong>Related: <\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/bridgemi.com\/michigan-government\/where-michigan-gubernatorial-candidates-stand-on-data-centers\/\"><strong>Where Michigan gubernatorial candidates stand on data centers<\/strong><\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/bridgemi.com\/michigan-environment-watch\/group-launches-campaign-overturn-michigan-solar-siting-law\/\"><strong>Group launches campaign to overturn Michigan solar siting law<\/strong><\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/bridgemi.com\/michigan-government\/whitmer-signs-energy-bills-make-michigan-use-clean-energy-2040\/\"><strong>Whitmer signs energy bills to make Michigan use clean energy by 2040<\/strong><\/a><\/li>\n<\/ul>\n\n\n\n<p>DTE Energy sued St. Clair County last year after officials <a href=\"https:\/\/www.stclaircounty.org\/Uploads\/BoC\/resolutions\/2025-13.pdf\">adopted those policies<\/a>, potentiallysetting up a new legal framework for local governments to exert more control over energy siting decisions.<\/p>\n\n\n\n<p>The county\u2019s regulations came in response to <a href=\"https:\/\/bridgemi.com\/michigan-environment-watch\/michigans-controversial-wind-solar-energy-law-effect-what-know\/\">Public Act 233<\/a>, which allows the Michigan Public Service Commission to bypass local rules and ordinances to approve wind, solar and battery projects. St. Clair County officials say the health department has more power to offer protections and can set its own standards.<\/p>\n\n\n\n<p>DTE was joined in its lawsuit<strong> <\/strong>by Portside Solar,<strong> <\/strong>a company that <a href=\"https:\/\/www.thetimesherald.com\/story\/news\/local\/2025\/09\/26\/fort-gratiot-solar-project-joins-dte-suing-st-clair-county-regulations\/86347367007\/?gnt-cfr=1&amp;gca-cat=p&amp;gca-uir=true&amp;gca-epti=z11xx48p117850c117850v11xx48d--52--&amp;gca-ft=107&amp;gca-ds=sophi\">has solar projects in St. Clair County<\/a>, arguing local officials lack the legal authority to enact the regulations and that the opinions of its health department \u201cwere not supported by any scientific or medical evidence.\u201d<\/p>\n\n\n\n<p>St. Clair County\u2019s medical director Dr. Remington Nevin contends that health department decisions are separate from Public Act 233 and codified under the Michigan Public Health Code. He argues that he is empowered to draft guidance to protect public health.<\/p>\n\n\n\n<p>Nevin said in <a href=\"https:\/\/stclaircounty.org\/PageBuilder\/scchd\/Uploads\/20250108%20Memorandum%20-%20Copy%201.pdf\">a January 2025 memo<\/a> that a local health department does not bear the responsibility \u201cto prove, with a precise scientific or medical rationale\u201d that the energy facilities pose an unreasonable public health threat to legally justify his authority.<\/p>\n\n\n\n<p>St. Clair County Circuit Court Judge Michael West sided with energy companies earlier this month and overturned the county\u2019s rules.<\/p>\n\n\n\n<p>In a statement to Bridge Michigan, DTE called the decision a \u201csound ruling,\u201d adding that the projects \u201cbring significant benefits to communities including tax revenues that can support schools, first responders, roads and more.\u201d&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Contentious issue<\/strong><\/h2>\n\n\n\n<p>The state\u2019s ability to sidestep local control of renewable energy projects has drawn the ire of <a href=\"https:\/\/michigantownships.org\/mta-board-votes-to-support-initiative-efforts-to-return-local-zoning-authority-for-large-renewable-energy-facilities\/\">several communities<\/a> in recent years. An initiative to reverse Public Act 233 <a href=\"https:\/\/bridgemi.com\/michigan-environment-watch\/wind-solar-farm-law-wont-make-november-ballot-michigan\/\">failed to make the ballot in 2024<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In St. Clair County, opposition to solar energy projects has remained a feature of public meetings as local residents oppose companies using farmlands and other rural locales for utility-scale development.&nbsp;<\/p>\n\n\n\n<p>\u201cThey\u2019ve been pretty much given carte blanche to do whatever they want in our townships,\u201d Sandra Richardson of Clyde Township told commissioners Thursday, imploring the board to act. <\/p>\n\n\n\n<p>\u201cWe need help.\u201dSt. Clair County&#8217;s attempt to restrict development of renewable energy sources is based on \u201cflawed and misleading public health theories,\u201d according to previous remarks by the <a href=\"https:\/\/www.sierraclub.org\/michigan\/southeast-michigan\/blog\/2025\/09\/objection-st-clair-county-s-restrictions-solar-energy\">Southeast Michigan Group of the Sierra Club<\/a>.
