change limiting civil arrests in state and local courthouses. <\/strong><\/li>\n\n\n\n<li><strong>The proposal comes as federal government cracks down on illegal immigration, increases civil immigration arrests in or near courts<\/strong><\/li>\n\n\n\n<li><strong>Some Democratic-leaning states have similar policies that have faced challenges from the Trump administration<\/strong><\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity is-style-wide\"\/>\n\n\n\n<p>Should law enforcement be barred from making civil arrests \u2014 including arrests of suspected noncitizens \u2014 in Michigan\u2019s state and local courthouses?&nbsp;<\/p>\n\n\n\n<p>It\u2019s a question the Michigan Supreme Court is considering as national tensions flare over the Trump administration\u2019s deportation tactics and a fatal shooting of a US citizen by an Immigration and Customs Enforcement officer in Minnesota.&nbsp;<\/p>\n\n\n\n<p>A <a href=\"https:\/\/www.courts.michigan.gov\/4aca16\/siteassets\/rules-instructions-administrative-orders\/proposed-and-recently-adopted-orders-on-admin-matters\/proposed-orders\/2025-14_2025-11-19_formor_propamdmcr8.115.pdf\">proposed rule change<\/a> announced last year by the Michigan Supreme Court \u2014 where six of seven current justices were appointed or nominated by Democratic governors \u2014 would prohibit civil arrests of people \u201cattending a court proceeding or having legal business\u201d in any of Michigan\u2019s trial or appellate courthouses.<\/p>\n\n\n\n<p>The rule as written would not interfere with criminal or court-ordered arrest warrants, but would cover most civil immigration arrests by federal law enforcement, which are typically administrative warrants.&nbsp;<\/p>\n\n\n\n<p><strong>RELATED:<\/strong>&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a courtroom<\/strong><\/a><\/li>\n<\/ul>\n\n\n\n<p>The court didn\u2019t make any final decisions in a <a href=\"https:\/\/www.youtube.com\/watch?v=9mQEFcGSYYw\">brief public hearing on the topic Wednesday<\/a>, and it\u2019s not clear when they might, but justices heard testimony they\u2019ll weigh alongside more than 2,500 comments submitted by individuals and organizations.<\/p>\n\n\n\n<p>Democratic Attorney General Dana Nessel is a prominent supporter of the proposed change and argues the potential rule may help mitigate fears that showing up to a courthouse could end in an arrest or racial profiling.&nbsp;<\/p>\n\n\n\n<p>\u201cIt&#8217;s causing havoc on untold levels for us,\u201d Nessel told Bridge Michigan in a Wednesday interview. \u201cNo one&#8217;s telling ICE that they can&#8217;t continue to enforce immigration law, but please don&#8217;t do it in a way that interferes with our system of justice and our state courthouses.\u201d<\/p>\n\n\n\n<p>The Trump administration has unsuccessfully challenged similar policies in other states as \u201csanctuary\u201d measures that obstruct lawful arrests.<\/p>\n\n\n\n<p>No opponents of the change addressed the court on Wednesday, but several wrote in public commentary that state courts shouldn\u2019t interfere with federal enforcement activity, arguing that immigration law should be followed both inside and outside of courthouses.&nbsp;<\/p>\n\n\n\n<p>\u201cI do not believe the courts should be in the business of making laws from the bench,\u201d Victoria Muterspaugh wrote in one comment submission. \u201cCome here legally or ICE will see you to the door.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What the rule would do&nbsp;<\/strong><\/h2>\n\n\n\n<p>If adopted, the new rule would add Michigan to the list of states attempting to limit immigration arrests following court proceedings, which have ramped up as President Donald Trump\u2019s administration works to deport undocumented immigrants amid a crackdown on illegal border crossings.<\/p>\n\n\n\n<p>States don\u2019t have jurisdiction over what happens in immigration courts, which are federal property, and cannot bar arrests there.&nbsp;<\/p>\n\n\n\n<p>But in state and local courthouses, immigrant advocates say the threat of arrest is preventing people from showing up to traffic court, testifying in hearings or performing other functions.<\/p>\n\n\n\n<p>Since last year, Washtenaw County has seen a \u201ctroubling increase\u201d in noncitizen victims of crime failing to show up in court to testify against their abusers, said County Prosecutor Eli Savit, a Democrat who is also seeking the party\u2019s nomination for attorney general.&nbsp;<\/p>\n\n\n\n<p>\u201cWhat that means is that victims of crime are frequently more afraid of the judicial system, more afraid of their own government, than they are (of) the person who harmed them,\u201d Savit told justices during Wednesday\u2019s hearing.&nbsp;<\/p>\n\n\n\n<p>It\u2019s unclear how many arrests have been made in courthouses, though one <a href=\"https:\/\/josephgunther.me\/assets\/Gunther_Quantifying_Immigration_Court_Arrests_Oct_7.pdf\">analysis from mathematician Joseph Gunther<\/a> identified 2,388 likely arrests in federal immigration courts nationwide between May and July 2025, including nine in Detroit.&nbsp;<\/p>\n\n\n\n<p>Immigration arrests appear to be less common when a person with no criminal history heads to a local courthouse to pay traffic tickets or testify in a hearing, but not unheard of.&nbsp;<\/p>\n\n\n\n<p>The Michigan Immigrant Rights Center and American Civil Liberties Union of Michigan <a href=\"https:\/\/www.aclumich.org\/sites\/default\/files\/field_documents\/immigrants_should_not_fear_arrest_while_seeking_justice_-_court_rule_request_4.11.25.pdf\">first called on Michigan courts to change the rules<\/a> around civil arrests in April after an incident outside Plymouth\u2019s 35th District Court where <a href=\"https:\/\/www.mlive.com\/news\/ann-arbor\/2025\/04\/us-citizen-mistakenly-detained-by-ice-outside-michigan-courthouse-speaks-out.html\">a US citizen was mistakenly detained by federal immigration enforcement.<\/a><\/p>\n\n\n\n<p>Immigration enforcement in courthouses violates longstanding Michigan law protecting litigants from civil arrests and has \u201cthe potential to seriously disrupt the fair and efficient functioning of our state courts,\u201d the directors of both organizations wrote in an April 11 letter.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>State courts\u2019 role in immigration debate<\/strong><\/h2>\n\n\n\n<p>A federal judge last year <a href=\"https:\/\/www.nytimes.com\/2025\/11\/18\/nyregion\/immigration-court-arrests.html\">dismissed a lawsuit from the Trump administration<\/a> that argued a similar policy in New York was unconstitutional and prevented federal authorities from apprehending criminals.<\/p>\n\n\n\n<p>In filing the suit, Attorney General Pam Bondi <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-files-lawsuit-stop-new-yorks-unlawful-protect-our-courts-act-obstructing\">had argued<\/a> the New York law amounted to a \u201csanctuary\u201d policy \u201cto prevent illegal aliens from apprehension\u201d that contradicted Trump\u2019s January executive order declaring a national emergency at the southern border with Mexico.<\/p>\n\n\n\n<p>Guidelines introduced under former President Joe Biden limited immigration arrests in courthouses and other so-called \u201cprotected areas\u201d like schools, hospitals and places of worship.
