The BB entered <a href=\"https:\/\/www.mlive.com\/news\/kalamazoo\/2021\/04\/kalamazoo-county-boy-critically-injured-after-bb-enters-brain.html\">just above his right eye and lodged in his brain<\/a>.&nbsp;<\/p>\n\n\n\n<p>Deven was in and out of hospitals for more than a year before dying from his injuries last July.<\/p>\n\n\n\n<p>His tragic story is what prompted state Rep. Julie Rogers, D-Kalamazoo, to introduce <a href=\"http:\/\/www.legislature.mi.gov\/(S(fknkrpgmilgskx0ye2z5qads))\/mileg.aspx?page=BillStatus&amp;objectname=2023-HB-4184\">House Bill 4184<\/a> in early March. According to a press release from Michigan House Democrats, nearly 10,000 Americans are injured by BB or pellet guns every year, with a majority of these being injuries suffered by minors.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/publications.aap.org\/pediatrics\/article-abstract\/141\/2\/e20173083\/38093\/Pediatric-Sports-and-Recreation-Related-Eye\">A 2018 study<\/a> in the journal Pediatrics found that roughly 10 percent of U.S. childhood eye injuries suffered in sports or recreational activities were caused by so-called \u201cnonpowder guns.\u201d The victims tended to be boys of about Deven\u2019s age and the injuries tended to be more serious, causing nearly half the hospitalizations, the study found.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Rogers, a physical therapist by profession, told Bridge Michigan that after hearing about Deven\u2019s case, she began to investigate laws surrounding BB gun usage in Michigan, and was dismayed to find that, in 2015, state restrictions were removed.<\/p>\n\n\n\n<p>Prior to 2015, under Public Act 186 a minor caught using a pneumatic weapon without adult supervision outside of their home or yard could be charged with a misdemeanor, punishable by up to 90 days in jail, or a maximum fine of $500. The act was repealed in 2015. While the current language of the new bill is ambiguous, the sponsor said its intent is to place responsibility on the adult who failed to supervise, not the child.&nbsp;<\/p>\n\n\n\n<p>Rogers\u2019 bill seeks to reinstate the original restrictions, something Rogers said Deven\u2019s family expressed their support for when <a href=\"http:\/\/www.legislature.mi.gov\/documents\/2021-2022\/billintroduced\/House\/pdf\/2022-HIB-6447.pdf\">the measure<\/a> was originally introduced in 2022.<\/p>\n\n\n\n<p>Rogers said the bill is not only about restricting minors, but about raising awareness of the dangers of these weapons.<\/p>\n\n\n\n<p>\u201cI think there\u2019s misconceptions that they\u2019re toys, or that they\u2019re not that serious,\u201d Rogers said. \u201cYou know, the joke from \u2018The Christmas Story,\u2019 the \u2018<a href=\"https:\/\/www.youtube.com\/watch?v=kPDY1uM4WKQ\">You\u2019ll shoot your eye out<\/a>\u2019 type of thing. And I think what a lot of people don\u2019t understand is that BB guns today are very different from those of the 1960\u2019s. They\u2019re more powerful, and can be much more dangerous.\u201d<\/p>\n\n\n\n<p>It\u2019s true that today\u2019s BB guns are different. In fact, the Daisy Red Ryder gun&nbsp; requested in the \u201cA Christmas Story\u201d scene, shot at a velocity ranging from <a href=\"https:\/\/www.washingtonpost.com\/archive\/lifestyle\/2004\/11\/26\/not-your-dads-bb-gun\/6ccffa5e-a5bb-45e2-9a5c-a17de827267c\/\">280-350 feet per second<\/a>. Today\u2019s Daisy models marketed to teens 16 and older can shoot upwards of <a href=\"https:\/\/www.daisy.com\/a-guide-to-picking-the-right-bb-gun\/\">800 feet per second<\/a>. (One study found that the required velocity of a BB to cut through human skin is around <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/7175470\/\">330<\/a> feet per second.)<\/p>\n\n\n\n<p>Brenden Boudreau, executive director of <a href=\"https:\/\/greatlakesgunrights.org\/\">Great Lakes Gun Rights<\/a>, which describes itself as a \u201cno compromise\u201d defender of the 2nd Amendment, recalled starting out as a child on a Daisy Red Ryder \u2014 a gun produced by a company founded in Plymouth. The pneumatic gun was a learning tool for him.<\/p>\n\n\n\n<p>\u201cI started shooting a BB gun when I was five or six years old,\u201d said Boudreau, who grew up in Tawas City. \u201cIt really is a good way to learn. There\u2019s no recoil, it\u2019s a lighter gun, it\u2019s something easy for youth to learn on.\u201d<\/p>\n\n\n\n<p>In his view, accidents involving these weapons are the fault of the user, or more accurately, the user\u2019s parents.<\/p>\n\n\n\n<p>\u201cThis (bill) is a solution in search of a problem,\u201d Boudreau said. \u201cIt\u2019s not that there (aren\u2019t) accidents that happen.&nbsp;<\/p>\n\n\n\n<p>\u201cThere are obviously irresponsible people that are going to not be responsible and allow their children to do dangerous things with not just BB guns, but with knives, cars, and all sorts of dangerous things.\u201d<\/p>\n\n\n\n<p>The bill is introduced at a time when a now-Democratic majority in the Michigan Legislature has passed a string of laws to tighten regulations on firearms. In March, Gretchen Whitmer signed bills establishing universal background checks and safe storage requirements in Michigan. And she recently signed a \u2018red-flag\u2019 law, allowing courts to order firearms removed from people considered a danger to themselves or others.&nbsp;<\/p>\n\n\n\n<p>But Rogers said her bill isn\u2019t a part of that.<\/p>\n\n\n\n<p>\u201cI think (House Bill 4184) is a little bit different, because it\u2019s not trying to limit or take someone\u2019s firearm away,\u201d Rogers said. \u201cIt\u2019s more about that adult supervision piece, because children might not have the best decision-making capacity.\u201d<\/p>\n\n\n\n<p>To Boudreau, the bill is similar to other bills in the legislature that are talking about firearms, primarily because to him, the solutions they are proposing aren\u2019t the right ones.<\/p>\n\n\n\n<p>\u201cI think that there are obviously great societal issues that we are struggling with as a nation,\u201d Boudreau said. \u201cWe have violence, we have mental health issues, and I think all of these solutions kind of take away the personal responsibility aspect. \u201cThey are attempting to put a Band-Aid on the bigger issues.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The measure would make it a misdemeanor for an adult to allow someone under 18 to use a BB, pellet or paintball gun when not on their property without adult supervision.
